Accidents with Uninsured Drivers: Who Pays My Deductible?
I was hit by an uninsured driver. Is he responsible to pay for my deductible? Taunya S.
When you have an accident with an uninsured driver, and the crash was his fault, not yours, some insurance companies will actually waive your deductible. For the ones that do not, often they will “subrogate against” (make a legal demand for the money back from) the responsible uninsured driver and the company will reimburse you for your deductible if they are successful. Now if you want to make a side deal with the at-fault driver to pay your deductible, let your insurance company know, and when they subrogate, they will ask only for the amount they paid out for your damages.
