In the state of Alaska, it is a crime to drive while intoxicated or impaired in any way. Alaska prosecutes “drunk drivers" under two theories: violating Alaska’s “per se” law, meaning, driving with a blood or breath alcohol content at or above the legal limit or driving while impaired.
