In the state of Idaho, what are the penalties for a first DUI offense? Second offense?
In the state of Idaho, a first DUI offense is considered a misdemeanor. You may be sentenced to up to 6 months in jail and your driver’s license will be suspended for no less than 30 days up to 5 months. You will also be fined up to $1,000. For second offenses, you may spend anywhere from 10 days to one year in jail, your driver’s license will be suspended for a minimum of one year after you have completed your jail sentence, and you will have to install an interlock system on your vehicle for up to one year after your license suspension ends. You will also be fined up to $2,000 and you cannot apply for restricted driving privileges during license suspension.
For third DUI offenses, you could receive anywhere from 30 days (minimum) up to 10 years in prison. You will be fined $5,000 and your license will be suspended for anywhere from 1-5 years after your prison term is complete. Third offenses require interlock for one year after your driving privileges have been reinstated.
